Ethics of subverting rules

Buchheit on hacking

Every system has two sets of rules: The rules as they are intended or commonly perceived, and the actual rules (“reality”).

Sometimes we catch a glimpse of the truth, and discover the actual rules of a system. Once the actual rules are known, it may be possible to perform “miracles” – things which violate the perceived rules. (Buchheit 2009)

Pound on law

[we can make] distinctions between law in the books and law in action, between the rules that purport to govern the relations of man and man and those that in fact govern them (Pound 1910, p. 15)

Sometimes distinctions are made between a rules letter and spirit.

Categorical imperative

can you also will that your maxim become a universal law? (Kant 1785/1998, v. 4:404)

Bending the Rules

Adhere to its letter and subvert its spirit.

Ferriss dehydrated and pushed other kickboxers out of the ring.

Other example?

Breaking Rules

To ignore its letter and spirit.

Altucher deceived usher, violating the rule that all those without tickets ought to be treated fairly.

  • Avery: “weaponized incompetence”?

Other example?

Stretching the Rules

To violate the letter but abide—or at least not violate—its spirit.

Altucher playing ping pong.

Other example?

Exploiting the Rules

To exploit a rule is to take advantage of (unjust) rules without acknowledgment.

Ferris and Sethi personal outsourcing.
